MandarinEar

Terms of Service

These Terms of Service govern your access to and use of MandarinEar. By using the service, you agree to these terms.

Effective March 26, 2026 · Updated September 17, 2026

1. Service Provider, Eligibility, and Accounts

MandarinEar is operated by ZHANG WENBIN, an individual developer based in China.

You must be legally capable of entering into binding agreements in your jurisdiction to use the service. You are responsible for maintaining accurate account information and safeguarding account credentials.

You are responsible for all activities that occur under your account unless unauthorized access results from our failure to apply reasonable security controls.

2. Acceptable Use

You agree to use MandarinEar only for lawful purposes and in accordance with these terms. You must not misuse the service, interfere with security, or attempt unauthorized access.

  • No automated scraping or abusive traffic patterns
  • No reverse engineering except where permitted by law
  • No infringement, fraud, or unlawful content distribution

3. Monthly Donut Race

The Monthly Donut Race is a skill-based monthly challenge in which eligible participants are ranked by qualifying XP earned during the applicable UTC month. No purchase is necessary. The top 10 eligible participants receive that month’s virtual donut collectible, which has no monetary value and is not transferable.

Participation in the Monthly Donut Race is subject to the Official Rules.

4. Intellectual Property and License

The service, including software, branding, and original content provided by MandarinEar, is protected by intellectual property laws. We retain all rights not expressly granted.

Subject to these terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the service for personal or internal learning purposes.

5. Third-Party Services

MandarinEar may integrate third-party services, including authentication, hosting, analytics, and payment providers. Your use of third-party services may be subject to their separate terms and privacy policies.

6. Refund Policy

6.1 Scope and Current Availability

This Refund Policy applies to paid MandarinEar subscriptions and other paid digital purchases. The provider named on your receipt determines where you manage the purchase and request a refund.

A purchase made through the MandarinEar website is billed by Paddle. A purchase made through the MandarinEar iPhone app is billed by Apple.

6.2 Purchases Through the Apple App Store

Apple handles billing and decides refund eligibility for purchases billed through the App Store. MandarinEar cannot approve or issue an App Store refund on Apple's behalf.

To request a refund, sign in at Apple's Report a Problem website and follow Apple's instructions. Eligibility and processing are governed by Apple's terms and applicable law.

6.3 Web Purchases Processed by Paddle

Paddle acts as the authorised reseller and merchant of record for Web purchases. Refund eligibility and processing are governed by Paddle's Refund Policy, Paddle's Buyer Terms, and applicable law.

You may request a refund using the support link in your Paddle receipt, through the billing portal in your MandarinEar Account, or through paddle.net. Refunds are not automatic or guaranteed merely because a subscription was canceled or unused. Paddle reviews eligibility and processes approved refunds under its policy and applicable law.

6.4 Cancellation Is Not a Refund

Canceling renewal prevents future charges but does not itself refund a charge already made. Unless the payment provider states otherwise, a canceled subscription remains available until the end of the period already paid for.

App Store subscriptions must be canceled through Apple's subscription settings. Paddle subscriptions must be canceled through Manage subscription in your MandarinEar Account, the management link in the Paddle receipt, or at paddle.net. Deleting your MandarinEar account, uninstalling the app, or restoring purchases does not cancel a subscription or request a refund.

6.5 Technical or Access Problems

If a purchase is not working as expected, contact us at hi@mandarinear.com so we can help investigate. Include the email address used for MandarinEar and the receipt or transaction identifier, but never send a full payment-card number.

Contacting MandarinEar support does not itself create or guarantee a refund. Refund requests must still be submitted to the provider that processed the purchase.

6.6 Effect of a Refund or Payment Reversal

If a refund, charge reversal, or similar payment adjustment is completed, access to the Premium entitlement connected to that transaction may end. The payment provider controls the refund method and processing time.

6.7 Consumer Rights

Nothing in this Refund Policy limits any consumer right or remedy that cannot be waived under applicable law. Where applicable law provides greater protection than this Refund Policy or a payment provider's standard terms, that law controls.

6.8 Changes and Contact

We may update this Refund Policy as our purchase options or legal obligations change. The payment provider's terms applicable to your transaction also continue to govern its refund process.

For questions about MandarinEar, your account, or access to Premium features, contact hi@mandarinear.com. For a refund decision, use the support channel of the provider shown on your receipt.

7. Suspension and Termination

We may suspend or terminate access if you materially breach these terms, create legal or security risk, or engage in abusive conduct.

You may stop using the service at any time. Termination does not affect rights or obligations that by nature should survive termination.

8. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory.

9. Limitation of Liability

To the maximum extent permitted by applicable law, MandarinEar and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, profits, or business opportunities.

Our aggregate liability arising out of or related to the service is limited to the amount paid by you for the service in the twelve months preceding the event giving rise to liability, or one hundred U.S. dollars (USD 100), whichever is greater.

10. Indemnification

You agree to defend, indemnify, and hold harmless MandarinEar from claims, liabilities, damages, losses, and expenses arising from your misuse of the service, violation of these terms, or infringement of third-party rights.

11. Changes to the Service or Terms

We may modify or discontinue features and may update these terms from time to time. Material updates become effective when posted unless a later date is stated.

12. Governing Principles and Dispute Resolution

These terms are interpreted and enforced in accordance with applicable law. Disputes should first be addressed through good-faith negotiation by contacting us.

If a dispute cannot be resolved informally, either party may seek relief in a competent forum with jurisdiction under applicable law.
